1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your access to and use of the Vandera mobile application, website and related services (together, the "Service"), operated by Vandera.app Ltd, a company registered in England and Wales under company number 16961305, with its registered office at Bartle House, 9 Oxford Court, Manchester, M2 3WQ ("Vandera", "we", "us" or "our").
By creating an account, downloading, accessing or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, which forms part of these Terms by reference.
If you do not agree to these Terms, you must not use the Service.
You must be at least 18 years old to create an account and use the Service.
2. Description of the Service
Vandera is a platform for the nomadic travel community. The Service allows users to discover, save and navigate to independently operated overnight locations ("Park ups") across the United Kingdom and Europe.
Park ups may include free locations, such as laybys and areas where overnight parking or camping may be permitted, and paid locations such as campsites, farm pitches and other independently operated sites.
The Service may also allow users to:
• Submit new Park ups
• Leave reviews and ratings
• Build and follow multi stop Trips
• Check in at locations to indicate current occupancy
• Access travel guides and other information relating to nomadic travel
• Access other features introduced by Vandera from time to time.
The core Service may be provided free of charge. Individual Park ups may charge a fee to stay, with any such fee set and collected by the third party host responsible for that location.
Vandera is a platform provider and does not own, operate or manage the independently operated locations listed on the Service unless expressly stated otherwise.
3. Third Party Locations
Park ups listed on Vandera may be independently owned, operated or contributed by third parties. Although Vandera may review information submitted to the Service and may apply its own verification or moderation processes, Vandera does not guarantee the safety, legality, accuracy, availability, suitability or condition of any Park up.
Information about a Park up may change after it has been added to the Service. This may include information about:
• Whether overnight parking or camping is permitted
• Access restrictions
• Facilities
• Pricing
• Availability
• Vehicle suitability
• Local rules or restrictions
• Host requirements.
You are responsible for exercising your own judgement before visiting or staying at any Park up. This includes:
• Checking that overnight parking or camping is currently permitted
• Complying with signage, restrictions, local bylaws and other applicable requirements
• Assessing whether the location is physically suitable and safe for your vehicle and circumstances
• Confirming current pricing and availability directly with the host where applicable
• Complying with all applicable laws and regulations, including those relating to parking, trespass and camping
• Following any reasonable rules or requirements imposed by the host.
Vandera does not act as an accommodation provider, does not guarantee that a Park up will be available and is not responsible for arrangements made directly between users and hosts.
4. Vehicle Compatibility and Route Information
The Service may use vehicle dimensions or other information provided by you to suggest suitable Park ups or identify potential route restrictions.
This information may include warnings relating to low bridges, narrow roads, weight restrictions or other access limitations.
This feature is provided as a convenience only and is not a substitute for your own route planning, current road signage or professional navigation tools.
Vandera does not guarantee that vehicle restriction or route information will be complete, accurate or current.
You remain responsible for determining whether a route and location are suitable and safe for your particular vehicle before travelling.
5. Your Account
Where an account is required, you must provide accurate and complete information when creating your account and keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
You must notify Vandera promptly if you become aware of unauthorised access to or use of your account.
You must not create an account using another person's identity or information without their permission.
You may delete your account through the relevant account settings within the App, where available, or by contacting Vandera directly.
Deleting your account does not necessarily remove information that Vandera is required or permitted to retain under applicable law or for legitimate business purposes, including where required to resolve disputes or comply with legal obligations.
6. User Generated Content
The Service may allow you to submit content including Park up information, photographs, reviews, ratings, reports and other material ("User Content").
You remain responsible for the User Content you submit.
By submitting User Content to Vandera, you grant Vandera a non exclusive, worldwide, royalty free licence to host, store, reproduce, display and distribute that User Content as reasonably necessary to operate, provide, promote and improve the Service.
You confirm that:
• You own the User Content or have the necessary rights and permissions to submit it
• Your User Content does not infringe the intellectual property, privacy or other rights of another person
• Your User Content is not unlawful, fraudulent, defamatory or deliberately misleading
• Any information you provide about a Park up is submitted in good faith based on information available to you.
You must not submit content that you know to be false or misleading, including false reviews or deliberately inaccurate Park up information.
Vandera may review, moderate, edit, refuse to publish, restrict or remove User Content where we consider this necessary to operate the Service, enforce these Terms, respond to reports or protect users, hosts or Vandera.
7. The Nomad Code and Acceptable Use
All users are expected to follow the Vandera Nomad Code and use the Service responsibly.
The Nomad Code promotes responsible nomadic travel, including consideration for hosts and local communities, responsible disposal of waste, minimising environmental impact and respecting other visitors and users.
You agree not to:
• Submit false, misleading, defamatory or malicious content
• Submit fraudulent Park up listings or reviews
• Harass, threaten or abuse another user, host or member of the Vandera team
• Use the Service for an unlawful purpose
• Use the Service in a way that infringes the rights of another person
• Attempt to gain unauthorised access to the Service, another user's account or Vandera's systems
• Scrape, copy, reproduce or redistribute substantial parts of the Service without prior written permission
• Interfere with the operation or security of the Service
• Use the Service to facilitate unlawful or harmful activity.
Vandera may suspend or terminate an account where a user seriously or repeatedly breaches these Terms or the Nomad Code.
8. Intellectual Property
The Service, including its software, design, branding, graphics, guides, text and other materials, is owned by Vandera.app Ltd or its licensors and is protected by applicable intellectual property laws.
Except where expressly permitted by these Terms or applicable law, you must not copy, reproduce, modify, distribute, publish, sell or create derivative works from the Service or its content without prior written permission.
This does not affect your rights in User Content that you own.
9. Service Availability and Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Vandera does not guarantee that:
• The Service will always be available
• The Service will be uninterrupted or error free
• Information provided through the Service will always be accurate, complete or current
• Park ups will be available when you arrive
• A Park up will be suitable for your vehicle or circumstances
• A Park up will remain available or legally usable
• The Service will meet every particular requirement you may have.
Vandera may modify, suspend or discontinue features of the Service from time to time.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
10. Limitation of Liability
To the fullest extent permitted by law, Vandera will not be responsible for indirect or consequential loss arising from your use of the Service.
This may include loss of profits, revenue, business opportunity, data or goodwill.
Vandera is not responsible for loss, damage, injury, fines or other harm arising from your decision to visit or stay at a Park up, except where such liability cannot legally be excluded or limited.
You remain responsible for checking the suitability, legality, safety and availability of a location before travelling or staying there.
Subject to any liability that cannot legally be excluded or limited, Vandera's total aggregate liability arising from or relating to your use of the Service shall not exceed the greater of: a) the total amount, if any, that you have paid directly to Vandera during the twelve months preceding the event giving rise to the claim; or b) £100.
Nothing in these Terms affects your statutory rights as a consumer under applicable consumer protection legislation.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Vandera.app Ltd, its directors, employees and agents from reasonable claims, liabilities, losses and expenses arising from:
• Your breach of these Terms
• Your User Content
• Your unlawful use of the Service
• Your infringement of another person's rights
• Your deliberate or negligent misuse of the Service.
This section does not apply to the extent that the relevant claim, loss or liability results from Vandera's own negligence, breach of duty or other conduct for which liability cannot legally be transferred to you.
12. Suspension and Termination
You may stop using the Service and delete your account at any time.
Vandera may suspend or terminate your access to the Service, with or without notice where permitted by law, if we reasonably believe that you:
• Have seriously or repeatedly breached these Terms
• Have engaged in unlawful conduct
• Have misused the Service
• Have attempted to compromise the security of the Service
• Have created a risk to users, hosts or Vandera
• Have provided materially false information.
Where appropriate, Vandera may take reasonable steps to give you notice of suspension or termination and the reason for it.
Provisions of these Terms which by their nature should continue to apply after termination will remain in effect, including provisions relating to intellectual property, User Content, disclaimers, liability and indemnification.
13. Changes to the Service and These Terms
Vandera may update or change the Service from time to time, including adding, removing or modifying features.
We may also update these Terms where reasonably necessary, including to reflect changes to the Service, legal requirements or how Vandera operates.
Where a change is material, we will provide reasonable notice where required by law.
The updated Terms will apply from the effective date stated in the updated version.
14. Privacy
Your use of the Service is also governed by Vandera's Privacy Policy.
The Privacy Policy explains how Vandera collects, uses, stores and protects personal information and sets out information about your rights under applicable data protection law.
You should read the Privacy Policy before using the Service.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have rights to bring proceedings in the courts of the part of the United Kingdom in which you live, where applicable.
Nothing in these Terms is intended to remove or restrict any mandatory consumer rights or protections that apply to you under the law.
